Overview

This course reflects the U.S. Department of Education’s April 19, 2024 Final Rule on educational institutions’ obligations to prevent sex discrimination, which takes effect on August 1, 2024. The Final Rule is the subject of legal challenges and courts have issued orders temporarily blocking its enforcement in several states. 

Where Enforcement of the Final Rule is Blocked

In a June 13, 2024 ruling in State of Louisiana et al. v. US Dept. of Education, et al., a federal court in Louisiana enjoined enforcement of the Final Rule in Idaho, Louisiana, Mississippi and Montana.

In a June 17, 2024 opinion and order in State of Tennessee et al. v. Miguel Cardona, et al., a federal court in Kentucky enjoined enforcement of the Final Rule in Indiana, Kentucky, Ohio, Tennessee, Virginia and West Virginia.

In a July 2, 2024 order in State of Kansas et al. v. Dept. of Education, et al., a Kansas federal court enjoined enforcement of the Final Rule in Alaska, Kansas, Utah, Wyoming and at the schools listed here.

In a July 11, 2024 opinion and order in State of Texas v. United States, et. al., a federal court in Texas enjoined enforcement of the Final Rule in the state.

In a July 24, 2024 order, a Missouri federal court enjoined enforcement of the Final Rule in Arkansas, Iowa, Missouri, Nebraska, North Dakota, and South Dakota.

In a August 22, 2024 order in State of Alabama, et al. v. US Secretary of Education, et al., the Eleventh Circuit Court of Appeals enjoined enforcement of the Final Rule in Alabama, Florida, Georgia, and South Carolina.
